Terms and conditions

Who you are contracting with

StationSites is a service of Martian Creative, LLC. In these terms “we” is that company and “you” is the station or owner buying the service.

What we provide

A website for your radio station, built to the description on this site, hosted by us, with a valid certificate on your domain. The monthly fee covers hosting, the content editor, and changes you ask us to make.

We aim to make requested changes within two business days. That is a target we hold ourselves to, not a guaranteed service level, and we will tell you when something will take longer.

What you provide

The content: your logo, your show and host information, your schedule, your stream, and anything else that is about your station. You confirm you have the right to use what you send us — photographs, logos and music included.

Fees

The setup fee is due before the build starts. The monthly fee is billed monthly in advance and starts when the site goes live, not when you sign. Prices are on the pricing page; if we change them we will tell you at least thirty days before it affects you.

Add-ons that meter usage — hosted live video past its included allowance — are billed for what you actually used, at the rate published on the pricing page.

Ending it

There is no minimum term. Cancel whenever you like and the service runs to the end of the month you have paid for. We do not refund part-months, and we do not charge an exit fee.

We can end it too, with thirty days’ notice — or immediately if the site is being used for something unlawful.

What you own, and taking it with you

Your content stays yours. Your domain stays yours. If you leave, we will hand over your content and the configuration that describes your station, in a form you can use, at no charge.

The website software itself — the theme every StationSites site is built from — stays ours and is licensed to you for as long as you are a customer. You are not buying the source code, and this is the ordinary arrangement for a hosted product.

Uptime

The site is static and served from a content delivery network, which is about as reliable as web hosting gets, but we do not promise a percentage. If our hosting is down, your site is down, and we will fix it as fast as we can.

Things that are not ours

Your audio stream, your streaming provider, your domain registrar and your social accounts are yours and outside our control. We will help you point them at the right place; we cannot be responsible when they fail.

Regulatory content

If your site carries an FCC public file page, the wording of the regulatory parts is ours and is not freely editable, because casually reworded compliance language is how a station gets into trouble. Keeping your public file complete and current remains your legal obligation, not ours.

Liability

We will do this job properly. If something goes wrong, what we owe you is limited to the fees you paid us in the twelve months before it happened. We are not liable for lost revenue or lost listeners.

Changes to these terms

If they change we will tell you, and the date at the top moves. Continuing to use the service after that means you accept the new version.
